Questions and Answers
What happens if I die without a will?
The law determines how your estate will be distributed. This is unlikely to be the way you want and may be expensive for Inheritance Tax.
Doesn’t it all just go to my wife?
Most unlikely. If you have kids only £125,000 plus income from a life interest in half the residue will go to the spouse! The rest will go to the children.
What about my young children?
Your Will can appoint the guardian(s) you would like to look after your minor children and provide supports otherwise someone else will decide.
Won’t I pay tax any way?
For an average family locally, there could be savings of tax of up to £110,000, with proper Tax Planning in a Will.
Surely my estate is not big enough?
Add the value of your house and life assurance and you may be surprised.
Can’t I just leave it to wife/partner?
Yes to husband/wife is tax free but then there is likely to be a big tax bill when they die. A good will means you can pass on your wealth and reduce the tax or pay none when they die. Gifts to partners are not exempt from Tax!
Those I have left it to will make a gift to friends/charity?
Frequently this does not happen. The only way to be certain is to specify The Gift in the Will.
